The final round of Java-war between Google Inc. and Oracle Inc. started on May 9. District Court in San Francisco, the United States finished selecting 10 members of the jury. They consisted of a lawyer, former CFO in airline, electrician, etc.

Judge Willium Alsup asked questions to them for several hours and lawyers of Google and Oracle did. The number of people related to computer area was just one. The juror majored in computer science in UC Berkeley, and the juror is working as network manager in Lawrence Berkeley Laboratory. The juror who donated to EEF(Electronic Frontier Foundation) was knowing the term ‘Fair Use’ only.
According to Ars Technica, most members of jury did not know the suit between Google and Oracle. Moreover, all of them once used Google’s product, but do not have strong affection for that any more than it is affected for the decision.
In 2010, it was started from complaint of Oracle – important issue is whether Fair Use is true or not.
This action is the last match for copyright violation lawsuit of Java since 2010. In the first trial that became a big issue both the patent and copyright, Google was acquitted with the patent, and the copyright was judged as infringement but received immunity due to Fair Use. Especially a justice department judged that Java API is not an object to the copyright protection. In fact, match for Google.
However, the ruling was overturned on appeal. Because the copyright of Java API is also protected, it was judged that Google infringed the copyright of Oracle, but it was thrown out to the first trial due to the discussion of Fair Use.
Now, this suit is engaged in a fierce battle that the infringement of Java’s copyright is whether Fair Use is true or not. Oracle will put in a claim for compensation of approximately 9.3 billion dollars.
